Infinicast Multimedia, LLC., Virtual Dedicated Server Terms of Service (TOS)

This Terms of Service (this "Agreement") along with the Acceptable Usage Policy ("AUP") governs your ownership of the Virtual Dedicated Server (the "Service") puchased from Infinicast Multimedia, LLC.

Infinicast Multimedia may modify and terms and conditions in the Agreement and AUP, at any time, at is sole discression.

Infinicast Multimedia agrees to provide services to the Subscriber, subject to the following TOS.

Payment Terms
The date of billing (the "Billing Date" will be every month on the date the Subscriber purchased the Service.  If said date of purchase falls on the 29th, 30th or 31st, the Billing Date will be automatically assigned to the 28th of each month as to avoid any confusion in billing.

Charges
You will immediately pay all charges for your use of the Service.  If you default on any of your obligations under this Agreement, your Service will be terminated after a 24hour written grace period.

All payments are processed through PayPal's <http://www.paypal.com/> subscription management system.

System and Network Security
Users are prohibited from violated or attempting to violate the security of the Infinicast Multimedia Network.  Violations of system or network security may result in civil or criminal liability.  Infincast Multimedia will investigate occurrences which may involve, and cooperate with law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:

• Accessing data or accounts not intended or authorized for such user.
• Attempting to probe, scan or test for vulnerabilities on the system or network.
• Attempting to disrupt service to a user, host or network, by means not limited to overloading, flooding, mail-bombing or crashing.
• Taking any action in order to obtain services which such user is not entitled.

Disclosure to Law Enforcement
The AUP specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that Infinicast Multimedia may disclose any and all Subscriber information, including assigned IP addresses, account history, account use, etc. to any law enforcement agency who makes a written request without further consent or notification to the Subscriber. In addition Infinicast Multimedia shall have the right to terminate all service set forth in this Agreement if requested to do so as a result of any action of any law enforcement or government agency.

Interuption of Service
Infinicast Multimedia and its supliers are not liable for any interuption in service caused by outages, "acts of God" or other causes beyond itscontrol (including any mechanical, electronic, communications or third-party supplier failure).
